What Offenders/Providers Need to Know!

To have one's driver's license re-instated, after the Division of Motor Vehicles (DMV) revocation period, the following administrative sanctions must have been completed.

  • Substance Abuse assessment
  • Completion of ADETS or a recommended treatment level
  • Paid State mandatory fees: $100.00 - assessment, $160.00 - ADETS or the first $75.00 of treatment services. Treatment providers charge additional fees that vary among agencies.

All assessments must be conducted:

  • In person by a qualified or certified substance abuse professional.
  • Using both a standardized instrument and a clinical interview.
  • Taking the breath test reading and one's prior driving record into account and
  • Using the DSM IV criteria to form a clinical impression.
  • You are required to bring your court papers to the assessment.
  • The assessor must have a copy of your "Complete Driving History" from DMV.

Assessment based referrals:

  • Shall be made consistent with the American Society of Addiction Medicine criteria
  • If there is not a DSM diagnosis, the client is referred to education. (ADETS). NOTE: Offenders failing to submit to a breath test and those registering over 0.14% are ineligible to attend ADETS and must be referred to a level of treatment.
  • The provider is required to inform you of other local providers who offer the service you need.
  • The provider may not charge a fee to transfer your case to another in-state provider.
  • Providers may charge for special services and for handling out of state cases.

Treatment Considerations:

  • Clients have a right to professional and ethical services based upon their identified level of need.
  • Clients may be asked to sign treatment contracts. Both the provider and the client are expected to honor such contracts.
  • Each client must have a certified counselor available to them.
  • Treatment groups shall be conducted by trained therapists, be limited to 20 clients and be conducted for the scheduled period of time.
